UPON PAYMENT OF THE PERMIT FEE, COMPLETION OF THIS PERMIT APPLICATION AND AN INSPECTION OF THE PROPERTY AND THE FLAGGED TREES, THIS PERMIT APPLICATION WILL BE APPROVED AS A PERMIT OR DISAPPROVED BY THE DESIGNATED REPRESENTATIVE OF THE BLUE RIVER BOARD OF TRUSTEES.

TREE REMOVAL FOR LAND OCCUPANCY __________ Section 3-9-3A, Blue River Town Code

Actual land occupied for buildings plus a space adjacent to the perimeter thereof, comprised of two zones. Zone 1 is the area extending fifteen feet (15’) from the outside combustible plane of a structure including decks, porches and other attached components of the structure. Zone 2 is the area extending an additional fifteen feet (15’) from the outside perimeter of Zone 1. The total distance that Zone 1 and Zone 2 combined extends from a structure’s combustible plane is thirty feet (30’). Removal of trees from Zone 1 or Zone 2 is permitted only pursuant to the determination by the Board of Trustees or its designated representative that such removal is consistent with the policy of this ordinance and the issuance of a permit.

TREE REMOVAL FOR DRIVEWAY, PARKING __________ Section 3-9-3B, Blue River Town Code

On residential lots, trees may be removed, pursuant to the determination by the Board of Trustees or its designated representative that such removal is consistent with the policy of this ordinance and the issuance of a permit, for one entrance driveway. The total width of the area from which trees can be removed for a driveway, including any snow storage area, shall not exceed thirty feet (30’) and an off-street parking area not more than one-third the size of the total floor area of the principal building on each lot.

TREE REMOVAL FOR RECREATIONAL AREAS _________ Section 3-9-3C, Blue River Town Code

Trees may be removed to create a recreational area not to exceed ten percent (10%) of the total area of the lot pursuant to the determination by the Board of Trustees or its designated representative that such removal is consistent with the policy of this ordinance and the issuance of a permit.

TREE REMOVAL FOR LANDSCAPING __________ Section 3-9-3D, Blue River Town Code

If the owner of a lot provides evidence to the Board of Trustees or its designated representative of the necessity for removal of trees for reasons other than set forth hereinabove, including but not limited to, landscaping, thinning and wildfire mitigation, trees may be removed for reasons approved by the Board.

OTHER TREE REMOVAL __________ Section 3-9-3E, Blue River Town Code

Diseased trees, trees damaged by natural causes, trees designated for removal described in a forest management plan and trees which interfere with utility lines map be removed pursuant to the determination by the Board of Trustees or its designated representative that such removal is consistent with the policy of this ordinance and issuance of a permit.

NEW CONSTRUCTION MODIFICATION __________ Section 3-9-4, Blue River Town Code

Any building or other structure for which a certificate of occupancy was issued after the effective date of this Ordinance shall conform with the requirements of 3-9-3(A) above, including creation of a Zone 1 and a Zone 2, except as modified by permit issued by the Board of Trustees or its designated representative. Any modifications shall be based upon the topography of the lot, its proximity to wildland, tree density, surrounding conditions and similar considerations.

DEFENSIBLE SPACE REGULATION (NEW CONSTRUCTION)

ZONE 1 (SLASH AND DEBRIS) __________ Section 3-9-5, Blue River Town Code

All slash and flammable debris shall be removed from Zone 1, except as otherwise allowed by permit issued by the Board of Trustees or its designated representative; EXCEPT THAT, firewood may be stored as follows: up to ten (10) cubic feet unregulated.


ZONE 1 (TREES AND SHRUBS) __________ Section 3-9-6A, Blue River Town Code

Within Zone 1 all trees and shrubs located within fifteen feet (15’) of a building or other structure shall be removed; EXCEPT THAT, a tree or shrub may remain within the aforesaid fifteen feet (15’) space provided the defensible-space distance is measured from the tree’s drip edge rather than the building plane (so that the tree is considered a part of or an extension of the structure), and provided that the defensible-space distance is not limited by a property line.

ZONE 2 (TREES AND SHRUBS) __________ Section 3-9-6B, Blue River Town Code

Within Zone 2 trees and shrubs over five feet (5’) tall shall have an average crown spacing of ten feet (10’) from tree to tree. However, groupings of trees are allowed, provided that all of the crowns in each group of trees are at least ten feet (10’) from any structure and provided that the overall average tree spacing within the defensible space is ten feet (10’) (i.e., tree spacing around tree groupings is greater than ten feet (10’)). EXCEPT THAT (1) aspen, narrow leaf cottonwoods, willows and other shrubs listed in Colorado State University publication 6.305, Firewise Plant Materials, may be closer than ten feet (10’) from a structure if allowed by permit issued by the Board of Trustees or its designated representative; and (2) closer spacing of any trees may be allowed by permit issued by the Board of Trustees or its designated representative upon determination that a ten feet (10’) average spacing would put the remaining trees at undue risk of wind-throw or snow breakage.
